EU forces Nintendo to allow cancellations of pre-orders

Since the launch of Nintendo Switch, eShop purchases have been considered final and no cancellation have been allowed. In European Union, there's a requirement to allow cancellation of titles not yet delivered. Nintendo have said they complied with this rule, as parts of the games got downloaded as soon as you ordered the game, even if it's not playable before launch and this Nintendo have considered as delivered

This way of reading the law have been disputed by Consumer Councils in Europe and brought to court

Cease and Desist

Now this have been up in court for the last three years and the ruling is out. Nintendo have received a cease and desist with this practices around denying users their right to cancel games not yet released

If Nintendo don't follow and implement this requirement. They can receive fines up to EUR 250.000 (~US$ 281 920) for each infringement or up to six months jail sentence for their director

Nintendo's respond

Nintendo have accepted the outcome and already implemented a cancellation option world wide

Cancelling pre-orders

Now you can cancel preorders either from the Nintendo Switch or the browser

Nintendo Switch 1) From the HOME Menu on your Nintendo Switch console, open Nintendo eShop and select the user that placed the pre-order. 2) Select your user icon in the upper-right corner to access your Account Information. 3) Select Pre-Orders from the right-hand menu to view any pre-orders you have placed. 4) Select Cancel Pre-Order next to the pre-order you wish to cancel.

Browser 1) Visit accounts.nintendo.com and sign in with the Nintendo Account that was used to place the pre-order. 2) Select Shop Menu. 3) Select Pre-Orders. 4) Select Cancel Pre-Order next to the pre-order you wish to cancel.
